Estos términos rigen la relación entre TzedakApp y la organización solicitante. Al marcar la casilla de aceptación durante el registro, un representante autorizado de la organización acepta estos términos en su nombre. Registramos la versión aceptada, la fecha, la dirección IP y el navegador utilizados.
TzedakApp recauda donaciones de sus usuarios a través de una cuenta de pagos central y las distribuye a las organizaciones aprobadas. TzedakApp actúa como facilitador tecnológico; no es un banco, ni agente del donante, ni recaudador oficial de la organización.
La organización debe estar legalmente constituida en la República de Panamá (personería jurídica vigente y RUC). TzedakApp puede aprobar, rechazar o suspender la participación de una organización a su discreción, y puede solicitar documentación adicional durante la revisión.
El donante paga exactamente el monto de su donación. No se descuenta comisión alguna: al momento de la distribución la organización recibe el 100% del monto donado. Los costos de procesamiento de pagos de Stripe, actualmente 4.4% + US$0.30 por transacción con tarjeta, y la operación de la plataforma son asumidos íntegramente por TzedakApp, financiados por un grupo de donantes de la comunidad, y nunca se trasladan a la organización ni se deducen de sus fondos. No existen cargos de ningún tipo para la organización. Ejemplo: de US$100 donados, la organización recibe US$100. Las distribuciones se realizan por transferencia bancaria en cortes periódicos (normalmente mensuales). Puede aplicar un monto mínimo de distribución; los fondos por debajo del mínimo se acumulan para el siguiente corte. Si en el futuro la plataforma necesitara introducir una comisión, esta no aplicará sin una nueva aceptación de términos.
La organización se compromete a: proporcionar información veraz y mantenerla actualizada (incluyendo datos de contacto y bancarios); destinar los fondos recibidos a fines lícitos y benéficos acordes a su objeto; y no tergiversar su relación con TzedakApp.
La organización recibe el nombre del donante y el detalle de sus donaciones únicamente para fines de agradecimiento y registro interno. No puede usar estos datos para marketing sin el consentimiento del donante, ni venderlos o compartirlos con terceros.
La organización es responsable de su propio tratamiento fiscal y de emitir cualquier certificado oficial de donación que exija la ley panameña. TzedakApp no emite certificados fiscales.
Ambas partes se otorgan una licencia limitada, mutua y revocable: TzedakApp puede mostrar el nombre y logo de la organización dentro del app, y la organización puede comunicar que participa en TzedakApp.
El servicio se ofrece "tal cual". TzedakApp no responde por interrupciones del procesador de pagos ni por causas de fuerza mayor. La responsabilidad total de TzedakApp frente a la organización se limita al monto total distribuido a esa organización en los 12 meses anteriores al reclamo.
Cualquiera de las partes puede terminar la relación con aviso por escrito. Los fondos pendientes al momento de la terminación se distribuirán en el siguiente corte.
Las nuevas versiones se notificarán al correo de contacto registrado. El uso continuado del servicio después de la notificación constituye aceptación. Mantenemos un historial de versiones.
Estos términos se rigen por las leyes de la República de Panamá, y cualquier disputa se someterá a los tribunales de la ciudad de Panamá.

These terms govern the relationship between TzedakApp and the applying organization. By checking the acceptance box during registration, an authorized representative of the organization accepts these terms on its behalf. We record the accepted version, date, IP address, and browser used.
TzedakApp collects donations from its users through one central payments account and distributes them to approved organizations. TzedakApp acts as a technology facilitator; it is not a bank, an agent of the donor, or an official collector for the organization.
The organization must be legally constituted in the Republic of Panama (valid legal status and RUC). TzedakApp may approve, reject, or suspend an organization's participation at its discretion and may request additional documentation during review.
The donor pays exactly the amount of their donation. No commission is deducted: at distribution time the organization receives 100% of the donated amount. Stripe's payment-processing costs, currently 4.4% + US$0.30 per card transaction, and platform operation are borne entirely by TzedakApp, funded by a group of community donors, and are never passed on to the organization or deducted from its funds. There are no charges of any kind to the organization. Example: of US$100 donated, the organization receives US$100. Distributions are made by bank transfer on periodic (normally monthly) cycles. A minimum distribution amount may apply; funds below the minimum roll over to the next cycle. If the platform ever needs to introduce a commission, it will not apply without a new acceptance of terms.
The organization agrees to: provide accurate information and keep it current (including contact and bank details); use received funds for lawful charitable purposes consistent with its mission; and not misrepresent its relationship with TzedakApp.
The organization receives the donor's name and donation details solely for gratitude and internal record-keeping. It may not use this data for marketing without the donor's consent, nor sell or share it with third parties.
The organization is responsible for its own tax treatment and for issuing any official donation certificates required by Panamanian law. TzedakApp does not issue tax certificates.
Both parties grant each other a limited, mutual, revocable license: TzedakApp may display the organization's name and logo within the app, and the organization may state that it participates in TzedakApp.
The service is provided "as is." TzedakApp is not liable for payment-processor outages or force majeure. TzedakApp's total liability to the organization is capped at the total amount distributed to that organization in the 12 months preceding the claim.
Either party may end the relationship with written notice. Funds pending at termination will be distributed in the next cycle.
New versions will be notified to the registered contact email. Continued use of the service after notice constitutes acceptance. We keep a version history.
These terms are governed by the laws of the Republic of Panama, and any dispute will be submitted to the courts of Panama City.
